NOTICE TO BUYERS

TERMS AND CONDITIONS OF AUCTION

 

  1. You must have a bidder number to buy. A bidder/buyer number will be issued with a valid driver's license, full address, phone number, and signature. The cashier must see license to verify any and all information. This bidder/buyer number will be recorded on the clerk's sheet when purchases are made. Settlement/Payment will be made accordingly, at the time you are ready to leave.

 

  1. Prospective bidders should inspect the property before any bidding starts to determine the condition, size and if it has been repaired or restored. It is the bidder's responsibility to determine description, age, authenticity and condition. All goods are exposed for public exhibition.

 

  1. All property is sold “as is”. There are no warranties made by the owner or the auctioneer.

 

  1. The highest bidder shall be the buyer. Upon fall of the hammer, or when the auctioneer says, “sold”, title of the property shall pass to the highest bidder. The auctioneer reserves the right to reject or accept the size of the bid. He may withdraw the article offered from the sale if the bid is not commensurate with the value of the article offered. In case of any disputes the decision of the auctioneer will be final. If there is any dispute between bidders, the auctioneer shall have sole and final discretion either to determine the successful bidder or to re-offer and resell the article in dispute.

 

  1. The auctioneers, their agents, the owners of the premises and all persons for whom the auctioneer may be acting on behalf of, shall not be liable to any person for damages to their person or property while in, on, or about these premises, nor shall they be liable for hidden defects. All persons are on these premises at their own risk.

 

  1. All buyers shall be responsible for goods after sold to them. All the merchandise must be removed and paid for day or evening of any sale.

 

  1. The clerk's records of all sales are absolute and final.

 

  1. Unless exempted by law the payment thereof, the purchaser will be required to pay Michigan State Retail Sales Taxes at a rate of 6%, or any taxes that are applicable at this date. We must see an Official Copy of your re-sales tax license for verification.

 

  1. The information and descriptions contained in the advertising material for this sale are, to the best of the auctioneer's knowledge, believed to be correct. The auctioneers assume no responsibility nor makes any warranties or covenants regarding it. It shall be the buyer's obligation to verify information and descriptions of property before purchase.

 

  1. Announcements the day or evening of sale shall take precedence over any printed material.

 

  1. Bidding on any item indicates acceptance of these terms and conditions. If you do not agree to the terms and conditions of this sale, please return your bidding card to the cashier.

 

  1. There is a 5% buyer premium when paying by charge, or bank debit cards. When paying by cash, no buyer premium is charged. Forms of payments are, Master, Visa, Am. Ex, and Discover cards.  No personal or business checks are accepted.
